A Blow Against H8

Hello folks!  I'm happy to announce - in case you don't know this from any other source - that Federal District Judge Vaughn Walker today overturned California's heinous Proposition 8, AKA Prop H8.  Please check out our dear friend & colleague Audrey Bilger, who also blogs for Ms.  Audrey's post on the ruling is right here.  To anticipate just a tad, part of Judge Walker's ruling reads as follows:
Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite-sex couples are superior to same-sex couples. Because California has no interest in discriminating against gay men and lesbians, and because Proposition 8 prevents California from fulfilling its constitutional obligation to provide marriages on an equal basis,the court concludes that Proposition 8 is unconstitutional.
Although Robert Frost's Banjo only occasionally ventures into the political arena, I've made my opinions about Proposition 8 - & by extension, similar measures in other states - clear on this blog since its early days in 2008.

  1. This was encouraging news to hear today, though the battle is certainly not over. It makes me proud to live in a city that helped push forward the movement for justice.

  2. Hi Ladrón: Good point that the fight will continue. I'm a bit concerned--maybe more than a bit concerned--about Justice Balls & Strikes Roberts & the other right-wingers on the Supreme Court. & yes, tho I don't live in California anymore, I'm sure SF was in the forefront of that battle.

    Mouse: It's a big step! Audrey will be blogging more on Ms later today I think.

    Tony: Yes--as you may know, our Supreme Court has some very conservative judges, so this is far from over, but a good step for sure.

    As a native Californian I was shocked when Prop 8 passed...and yesterday's news was good news, a big step forward toward equality for all. I wrote about it on one of my blogs last night also.
